1. Agreement

By creating an account or using TomdacatAI ("Service"), you agree to these Terms of Use ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation. If you do not agree, do not use the Service.

These Terms are between you and TomdacatAI("we", "our", "us"), the operator of TomdacatAI at ai.tomdacat.com.

2. Description of Service

TomdacatAI provides access to AI language and image/video models via an API, dashboard, and playground interface, primarily for use in Roblox games and developer projects. We route requests to underlying model providers including Pollinations.ai, OpenRouter, Together AI, Fireworks AI, Cerebras, InferencePort, Ezra, Inception Labs, Novita, Celeris, and Picsart.

The Service is fronted by Cloudflare for network security and DDoS protection. See our Privacy Policy for details on how this affects your data.

Features, products, plans, and individual AI models offered through the Service — including Tomdacat Code and Browser Use described below — may be added, changed, restricted, or discontinued at any time, at our discretion, with or without notice.

3. Eligibility & Account

You must be at least 16 years old to use the Service. You authenticate via Discord OAuth; you are responsible for keeping your Discord account secure and for all activity under your TomdacatAI account. Notify us immediately of any unauthorised access.

You may not share your API key with untrusted parties or use it in publicly accessible client-side code.

4. Credits & Billing

Credit types

The Service operates on a credit system with two pools: lite credits (consumed first, usable on eligible models) and pro credits (required for premium models and consumed when lite credits are exhausted or the model is paid-only).

Purchasing credits

Pro credits are purchased through the TomdacatAI Roblox experience using Robux via Roblox's payment systems. All purchases are subject to Roblox's terms and refund policy. We do not process card payments directly.

No refunds

Credits are non-refundable except where required by applicable consumer law. Credits have no cash value and may not be transferred between accounts.

Expiry

We reserve the right to expire unused credits after a period of account inactivity (we will provide reasonable notice before doing so).

Promotional codes

Promotional codes may be issued at our discretion. Each code has defined credit amounts, credit type, and usage limits as specified when issued. Codes may not be resold.

5. Acceptable Use

You agree not to use the Service to:

Generate or distribute illegal, harmful, harassing, defamatory, or abusive content.
Produce or facilitate child sexual abuse material or any sexualised content involving minors — strictly prohibited and will be reported to the National Center for Missing & Exploited Children (NCMEC) CyberTipline and relevant law enforcement, as required by law, including 18 U.S.C. § 2258A.
Generate malware, phishing content, or instructions designed to facilitate real-world harm.
Attempt to circumvent safety systems, rate limits, or access controls.
Scrape or bulk-harvest outputs for training competing AI models without our written consent.
Violate the acceptable use policies of underlying model providers (including Pollinations.ai and applicable third-party platforms).
Impersonate any person or entity, or misrepresent your affiliation.
Use the Service for any purpose that violates applicable law.

We may suspend or terminate accounts that violate these rules without prior notice.

6. Bot Hosting Service

TomdacatAI provides infrastructure to host Discord bots on your behalf (the "Hosting Service"). This section governs your use of that feature.

Your bot, your responsibility

You own your Discord bot and are solely responsible for it. This includes everything your bot does: messages it sends, commands it runs, servers it joins, and any content it generates or distributes. We provide the hosting environment only — we do not control, monitor, or endorse your bot's behaviour.

Discord compliance

Your bot must at all times comply with Discord's Terms of Service, Discord's Developer Policy, and Discord's Community Guidelines. You are responsible for ensuring that your bot's behaviour, the servers it operates in, and the content it generates or relays are all lawful and compliant. Any violation of Discord's policies may result in immediate termination of the bot and your account.

Bot token storage

When you add a bot to the Hosting Service, you provide your Discord bot token. We store this token encrypted using AES-256-GCM with a unique initialisation vector per token. The plaintext token is decrypted only on our servers when your bot is running and needs to connect to Discord — it is never returned to your browser, included in API responses, or accessible to other users. You remain the sole owner of your bot token and can revoke it via the Discord Developer Portal at any time, which will immediately stop your hosted bot.

Daily hosting fee and usage billing

Running a hosted bot costs a small daily credit fee, deducted automatically from your account, that covers the bot's process slot on our infrastructure. AI calls your bot makes — chat responses, image generation — are billed separately at the same per-token or per-image rate as any other use of the API. If your balance falls below the threshold required for the next day's fee, your bot will be stopped automatically and its status set to an error state. You can restart it once you have topped up your balance. Hosting fees are non-refundable, including for periods where your bot encountered errors or was offline due to insufficient credits.

Custom code

If you upload your own Python file or use our AI assistant to generate one for your bot ("Custom Code"), you are solely responsible for that code and everything it does, in addition to everything in "Your bot, your responsibility" above. Custom Code passes through an automated review before it can run. This review is a filter against obviously unsafe submissions, not a guarantee: it does not certify your code is safe, bug-free, or fit for any purpose, and an "approved" verdict does not waive your responsibility for it. We apply resource limits and automated monitoring to Custom Code processes and may suspend or terminate a bot that exceeds them, without notice, to protect the hosting infrastructure and other users. We do not review Custom Code for correctness and are not liable for any loss arising from its behaviour, including data loss, unintended messages sent by your bot, or account or credit consumption caused by your code.

Data stored for your bot

In addition to your token, we store your bot's name, AI model selection, system prompt, plan tier, operational status, and cumulative usage counters. If you use the ticket bot feature with "Save Transcripts" enabled, messages sent by Discord users in your support channels — including their Discord user IDs, usernames, and message text — are stored in our database and linked to your bot. You are responsible for disclosing this to your Discord server members and complying with all applicable data protection laws regarding their data.

Our right to stop or remove bots

We reserve the right to stop, suspend, or permanently delete any hosted bot at any time if we determine it violates these Terms, Discord's policies, applicable law, or poses a security or operational risk to our infrastructure. Where practical we will notify you, but we are not obligated to do so before taking action.

No guarantee of uptime

We make no guarantee of uptime, availability, or continuity for the Hosting Service. Bot hosting may be interrupted for maintenance, infrastructure changes, or events outside our control. We are not liable for any loss or damage resulting from bot downtime.

7. Tomdacat Code

Tomdacat Code is a separate, subscription-based product from the credit-billed API described in Section 4: a flat monthly Robux plan that grants access to a fixed set of models plus a rolling session (5-hour) and weekly (7-day) token allowance, instead of per-token credit billing. It does not draw from or affect your lite/pro credit balance, and balances do not carry over between the two products.

Plans and activation

Current plans, their models, and their limits are published on your Tomdacat Code dashboard. Plans are purchased via Discord and activated on your account by us — there is no automated recurring card or Robux charge. A plan grants access for its stated period; we do not pro-rate or refund unused days if you cancel, if we suspend your account, or if we change or discontinue the plan as described below.

Separate API keys and fair use

Tomdacat Code uses its own API keys, separate from your main platform key, and its own rolling usage limits enforced automatically per plan. Requests that exceed your session, weekly, or model-specific allowance are rejected until the relevant window resets; this is not an error and does not entitle you to compensation. Section 5 (Acceptable Use) applies to Tomdacat Code in full.

We may change or withdraw plans and access at any time

Tomdacat Code, its plans, pricing, included models, token limits, and the product as a whole are offered at our discretion and may be changed, restricted, suspended, or discontinued at any time — for an individual account or across all users — with or without notice. This includes reducing or removing the models available on a plan, lowering token limits, and revoking an active subscription for suspected abuse or non-payment. Where practical we will give notice, but continued availability of any specific plan, model, or limit is never guaranteed.

8. Browser Use

Browser Use is a research-preview playground feature that lets a compatible AI model control a real, remote web browser on your behalf — navigating, clicking, typing, and reading pages — to complete a task you describe. It runs on third-party cloud sandbox infrastructure (see our Privacy Policy) and is experimental: expect bugs, unexpected behaviour, and changes without notice.

Your responsibility for what the browser does

You are solely responsible for the tasks you give Browser Use and for anything it does as a result, including any website it visits, account it accesses, form it submits, or content it views or downloads. You must have the right to take any action you ask it to perform. Do not use Browser Use to access accounts, systems, or data you are not authorised to access, to circumvent CAPTCHAs, paywalls, rate limits, or access controls on third-party sites, or to violate the terms of service of any website it visits. Section 5 (Acceptable Use) applies in full.

Billing

Browser Use is billed from your lite/pro credit balance by the minute the underlying browser sandbox is running, in addition to normal per-token billing for the AI model's own responses during the session. A session ends automatically after a fixed maximum duration or period of inactivity. Credits spent on Browser Use are non-refundable, the same as any other use of the Service.

No guarantee of availability

As a research preview, Browser Use may be limited, rate-limited, suspended, or discontinued at any time, at our discretion, and we make no guarantee of its availability, reliability, or continued existence as a feature. We are not liable for any loss or damage resulting from its unavailability or from actions it takes at your direction.

9. Developer Marketplace & Apps

TomdacatAI lets developers register applications ("Apps") that other users can authorise to access the Service on their behalf via app tokens and scoped permissions.

If you register an App, you are responsible for its behaviour, the security of your app token and client secret, and for accurately describing what your App does to the users who authorise it. If you enable developer earnings, you will receive a share of usage revenue generated through your App, credited to your account as described in your dashboard; we may withhold or claw back earnings obtained through fraudulent or abusive use.

If you authorise someone else's App, you are granting it the scopes and limits you configure (such as credit caps or model restrictions) — you can revoke an App's access at any time from your dashboard.

We may suspend or remove any App that violates these Terms, abuses the Service, or poses a security risk, without prior notice where necessary.

10. Referral Program

We may offer bonus credits to you and a friend when they create an account using your referral link or code. Referral bonuses are issued at our discretion, are non-transferable, and may be clawed back if we determine the referral was fraudulent, self-referred, or otherwise abusive. We may change or discontinue the referral program at any time.

11. Discord Linked Roles

Discord Linked Roles, where connected on your account, authorises us to push limited account metadata (such as whether you have an account, your total API request count, and account age) to Discord so that Discord servers can grant roles based on it. If you have connected Linked Roles and want it disconnected, contact us and we will disconnect it and stop further metadata updates.

12. AI Model Providers

The Service routes your requests to third-party AI inference providers. By using the Service you acknowledge that:

Your prompts and inputs will be transmitted to the relevant provider for the model you select.
Provider terms and content policies apply to their respective models.
We are not responsible for the content, accuracy, or safety of model outputs.
Provider availability may affect Service uptime; we do not guarantee uninterrupted access.

13. Your Content

You retain ownership of prompts you submit. By submitting prompts, you grant us a limited licence to process them solely to deliver the Service (including forwarding to model providers). We do not use your content to train AI models without your explicit opt-in.

You are solely responsible for ensuring your prompts and their intended use comply with applicable law and these Terms.

14. Intellectual Property

All software, design, branding, and documentation of the Service is owned by or licensed to us. Nothing in these Terms transfers intellectual property rights to you beyond the limited right to use the Service as described herein.

AI-generated outputs may be subject to the intellectual property policies of the underlying model provider. We make no representation as to the copyright status of AI-generated content.

15. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement. AI outputs may be inaccurate, incomplete, or inappropriate — always review outputs before use in production.

We do not warrant that the Service will be uninterrupted, error-free, or secure.

16. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total liability to you for any claim arising from these Terms or the Service will not exceed the credits or fees you paid us in the 3 months preceding the claim.

Nothing in these Terms limits liability for death, personal injury, fraud, gross negligence, or willful misconduct, or any other liability that cannot be excluded by law.

17. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages (including legal fees) arising from your use of the Service, your violation of these Terms, your bot's behaviour on Discord, or your infringement of any third-party right.

18. Suspension & Termination

We may suspend or terminate your account at any time for breach of these Terms, suspected abuse or fraud, or for legal/regulatory reasons. Where practical we will give prior notice. You may delete your account at any time by contacting us; credit balances are forfeited on deletion unless otherwise agreed.

On termination, Sections 13–17, 19, and 20 survive.

19. Governing Law & Disputes

These Terms are governed by the laws of the European Union and, where applicable, the national laws of the EU member state in which the Service is operated. Any disputes will be subject to the exclusive jurisdiction of the competent courts within the European Union, except where mandatory consumer protection laws in your country of residence give you additional rights.

20. Changes to These Terms

We may update these Terms from time to time. We will post the new effective date above and, for material changes, provide at least 14 days' notice via the dashboard or by email where available. Continued use after the effective date constitutes acceptance of the revised Terms.
